Why is personal information held?

Personal information about you will only be taken to help provide you with the most appropriate care. Sometimes, this will mean sharing information about you with other agencies and organisations - e.g. health. An agency is an organisation or a person who works with you to provide you with a service, help, or support - for example your social worker, health visitor or doctor.

What are the rules about information sharing?

Your personal information must be kept secure and up to date - this is the responsibility of each agency providing a service to you. The laws and policies that have to be followed when dealing with your personal information are:

When can your information be shared with others?

With your consent: The law says that you have to agree to allow information about you to be shared between one agency and another unless there are statutory grounds or other overriding justification for doing so. This means that there may be times when we will need to share information about you without your consent.

You will be asked to give consent by signing a form called the 'sharing information agreement form'. This will happen when you are assessed. By giving consent, you are allowing an agency to share your personal information for the purposes of providing you with 3 effective treatment and care.

Without your consent: There are a limited number of situations where information can be shared without your consent. The main circumstances where this might happen are:

You can also withdraw consent or restrict the sharing of certain personal information. Choosing to either withdraw consent or restrict the sharing of all or parts of personal information held may mean that the level of health and care service that you receive may be affected.

How is your information stored?

Personal information is confidential. Personal information about you will either be stored electronically on a computer database or in a secure manual filing system (i.e. paper files).

You have the right to:

You have the right to see your personal information, but there will be some information that we cannot show you. For example, you will not be allowed to see information that contains details about someone else, even a member of your own family, unless that person has given permission.

We have the right not to release personal information about you to you under certain circumstances: If we feel that access is likely to cause you or another individual serious harm. If the information that you are requesting from us has originated from a health professional (e.g. G.P.). In this instance, we would have to write to the relevant professional or Health Authority for permission to release this information to you. If the information released to you is likely to disclose the identity of another individual.

How is your information used?

The people working with you use the information to understand your circumstances and provide the best help available. This may sometimes require your information to be shared with other agencies. Your information may also be used to produce numerical reports and statistical analysis. Your personal details will not be identified in these.
