1. Please could you confirm what are the individual elements that your Authority includes within their bond requirement for all highways work for S278 and S38 agreements?

2. Please could you provide an average value for bond provision for S278 and S38 agreements?

3. Please confirm what items of highway apparatus currently attract commuted sums, and what are the individual costs?

4. Would you consider using the developer obtained tender value for calculating the bond provision for S278 and S38 agreements?

5. Please could you confirm your inspection fee or percentage applicable relevant to the bond provision for S278 and S38 agreements?

Section S278 Agreements relating to residential developments during each of the past 5 financial years.

Please could you confirm the average time taken from technical submission to the issue of a technical approval?

Please could you confirm what is the average time from technical approval to the completion of a Section 278 legal agreement? i.e. legal engrossment?

Please could you confirm the average time to grant a Streetworks Permit, post execution of the document in question 2?

What in your opinion is an appropriate timescale for the submission and financial execution of a S38/ 278 Agreement?

What improvements do you think could be made to the overall process from submission to engrossment?

Highway Bond Provision

1. All highways works on the adopted highway or that will be offered for adoption

2. Difficult to provide as S278 and 38 agreements vary between sites. Lower amount is generally £50k, with an upper limit of in excess of £2m

3. Any apparatus that is not standard equipment, such as Traffic Signals, Sustainable Drainage systems, bespoke street furniture, etc. Individual costs vary in relation to scheme

4. No. This is requested and then evaluated against Authority Term Contract Rates

5. Up to £1m – 3.5% for design check/initial fee; 5% for supervision; Over £1m – 5% flat fee

Highway S38/S278 Timescale

Section S278 Agreements relating to residential developments during each of the past 5 financial years.

Target is between 3 and 6 months for technical approval, depending on size of works. We are not able to provide an average time as in doing so would exceed the ‘appropriate limit’, which for local authorities is 18 hours.  This applies to the time taken spent locating and collating the requested information
