Notice of Confirmation of Public Path Diversion and Definitive Map Statement Modification Order 2019

Highways Act 1980 and Wildlife And Countryside Act 1981.

On 22 June Thurrock Borough Council (“the authority”) Confirmed the above Order, under section 119 of the Highways Act 1980 ("the 1980 Act") and Section 53A(2) and Section 53(2)(b) of the Wildlife and Countryside Act 1981, the effect of the Order as confirmed is to divert public Footpath 160 running from Harrow Road through the Former Harrow Inn to the property boundary as shown on the Order map.

This Order is also made under sections 53A(2) and 53(2)(b) of the Wildlife and Countryside Act 1981 ("the 1981 Act") because it appears to the authority that the Definitive Map and Statement requires modification in consequence of the occurrence of an event specified in Section 53(3)(a)(ii) and (iii) of the 1981 Act, namely, the diversion (as authorised by this Order) of a highway shown or required to be shown in the Definitive Map and Statement.

A copy of the Order together with the plan will be available for inspection by appointment for a period of 42 days at the Civic Offices, New Road, Grays, RM17 6SL, during normal office hours between 9am to 5pm Monday to Friday appointments can be made by telephone to 01375 652 350. This Order becomes operative as from the date on which it is certified by Thurrock Borough Council that the new highway has been created to the council’s reasonable satisfaction and shall give notice of it's coming into operation in the Thurrock Gazette.

If any person aggrieved by the Order desires to question the validity, or that of any provision contained in it, on the ground that it is not within the powers of the 1980 Act or the 1981 Act, or on the ground that any requirement of that Act, or any regulation made under the 1980 Act or 1981 Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the 1980 Act as supplied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from Friday 26 July 2019, make an application to the High Court.
