Public Footpath 85, South Hill to Tyelands Farm, Langdon Hills

Notice of Confirmation of Public Path Diversion and Map Modification Order 2019

Highways  Act 1980 and Wildlife And Countryside Act 1981.

On 22 June 2019 Thurrock Borough Council (“the authority”) confirmed the above Order made under Section 119 of the Highways Act 1980 ("the 1980 Act") because it appears to the authority that it is in the interests of the owner of the land crossed by Footpath 85 described in paragraph 1 of this Order and it is expedient that the line of the path or way known as Footpath 85, or part of that line, should be diverted as described in paragraph 3 of the Order.

This Order is also made under sections 53A(2) and 53(2)(b) of the Wildlife and Countryside Act 1981 ("the 1981 Act") because it appears to the authority that the Definitive Map and Statement requires modification in consequence of the occurrence of an event specified in Section 53(3)(a)(ii) and (iii) of the 1981 Act, namely, the diversion (as authorised by this Order) of a highway shown or required to be shown in the Definitive Map an Statement.

A copy of the Order as confirmed and the Order map will be made available for inspection by appointment for a period of 42 days at the Civic Offices, New Road, Grays, RM17 6SL, during normal office hours between 9am and 5pm Monday to Friday by appointment made by telephone to 01375 652 350. The Order came into force on 22 June 2019, but If any person aggrieved by the Order desires to question the validity, or that of any provision contained in it, on the ground that it is not within the powers of the 1980 Act or the 1981 Act, or on the ground that any requirement of that Act, or any regulation made under the 1980 Act or 1981 Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the 1980 Act as supplied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from Friday 26 July 2019, make an application to the High Court.
