Off-street Parking and Waiting Restrictions Order 2005 (as amended)
The Borough of Thurrock (Off-Street Parking Places) Order 2005 Amendment No.8)
1) Notice is hereby given that Thurrock Borough Council, in exercise of the powers under sections 1, 2, 4 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (hereinafter referred to as “the 1984 Act”) and all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the1984 Act, intends to make the above named Order (“the Proposed Order”).
2) The general effect of the Order would be to make the following variations to articles and definitions in “The Borough of Thurrock (Off-Street Parking Places) Order 2005;-

“Cashless Payment” means as defined by Payment Services Regulations2017 a payment made via an electronic device such as mobile phone, telephone, smartphone, computer or any other method which is being an act, initiated by the payer or on his behalf or by the payee, of placing, transferring or withdrawing funds, irrespective of any underlying obligations between the payer and the payee, not being a service to which paragraph 2 (f) applies whereby the charge levied under the Council’s tariff of charges (and appropriate administration charge) is collected by the Service Provider or the Council as the case may be, via scriptless money, and electronic money as defined in Regulation 2(1) of the Electronic Money Regulations 2011. such as by credit card or debit card or other means of authorised payment
“Parking Ticket” means a ticket lawfully obtained from a ticket machine provided by the Council or its agents for the issue of parking tickets appropriately dated and time stamped, or a virtual permit obtained by the telephone or Electronic Payment System and recorded on a handheld device
“Parking Ticket Machine” means an apparatus designed to issue a parking ticket indicating the payment of a charge by way of cash or a payment card, for the leaving of a vehicle in a payment parking place and the period in respect of which that charge has been paid;
“Payment Parking Place” means any designated parking place including any access road thereto from the public highway and provided by the Council under Section 32 of the Road Traffic Regulation Act 1984
“Permit” means a hardcopy Permit or virtual permit issued by the Council or its Service provider under the provisions of this Order
“Service Provider” or “Agent” means any contractor authorised by the Council to accept payment of the parking charge either for a Parking Ticket or a Permit or both, on its behalf
“Telephone or Electronic Payment System” means a system to facilitate and monitor the payment of the Parking Charge using telephone, smartphone, computer, or any other so authorised method enabled device via communication with the Service Provider or the Council, in accordance with the Terms and Conditions displayed and located at or in the vicinity of each Parking Place;
“Virtual Permits” means an electronic record of a Permit issued and validated by the Council under the provision of this Order.
Save as provided for in Article 8 (2) of this Order, no Vehicle shall be left in a Pay and Display Parking Place unless displaying, a valid and appropriate Parking Ticket obtained from a Ticket Machine provided in the Pay and Display Parking place, in a prominent position within the said Vehicle such that the said Parking Ticket can be read in its entirety from outside the Vehicle by any Civil Enforcement Officer carrying out their normal enforcement duties, unless that Parking Ticket holder or Permit holder has been granted a Virtual Parking Ticket or Permit in receipt of a Cashless Payment using the Telephone or Electronic Payment System which exempts them from displaying a Parking Ticket or Permit and is accessible on an electronic database approved by the Council using a Handheld Device during the whole of the time that the Vehicle remains in the Parking Place, so that it can be read by any Civil Enforcement Officer carrying out their normal enforcement duties

Exemptions to the General Prohibitions
14. (1) The following are exempt from the general prohibition as set out in Articles 5 to 13 of The Borough of Thurrock (Off-Street Parking Places) Order 2005:
(a) a vehicle, necessarily required for use in connection with any if the following
operations, namely:
(i) the removal of any obstruction to traffic;
(ii) the maintenance, improvement or reconstruction of the areas covered by the order
(iii) the laying, erection, alteration or repair in or on land adjacent to the areas, lengths of Streets or sides of Streets of any sewer, or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telegraphic line by a utility organisation while attending to their apparatus;
or
(b) in relation to a vehicle being used –
(i) for police, ambulance or fire and rescue authority purposes;
(ii) a vehicle in the service of a local authority in pursuance of statutory powers;
(iii) in the service of water or sewage undertakers within the meaning of the Water Authority Act 1991; or
(c) in relation to a vehicle waiting when the person in control of it is -
(i) required by law to stop;
(ii) obliged to stop in order to avoid an accident; or
(iii) prevented from proceeding by circumstance outside the drivers control;
(d) a public service vehicle whilst at an authorised stopping place terminal or timing point;
(e) a vehicle being used to attend an emergency by a Doctor or District Nurse or Midwife. The Council may require evidence to show that there was an emergency.
(f) a vehicle validly displaying a blue badge in the circumstances prescribed in Regulations 7, 8 or 9, but subject to the limitation set out in Regulation 6(2) of the Local Authorities’ Traffic Orders (Exemptions for Disable Persons) (England) Regulations 2000 SI 683;
(g) a vehicle validly displaying in the relevant position a blue badge parked in any residents’ parking place at any time;
(h) a vehicle validly displaying a valid permit issued under one of the Articles 7 to 8 of this Order;
(i) a motor cycle parking in any residents’ permit parking place, or permit parking
area or payment parking place at any time;
(j) a vehicle displaying a valid parking ticket insofar as it is parked within a payment parking place
(2) If and insofar as a vehicle described in Articles 13(1)(g)-(j) of this Order is parked in a parking bay that the vehicle must be wholly parked within that parking bay.
