Running Sheet/Tracker Sheet
I write to make a Business as Usual / General Enquiry in relation to the example Tracker Sheet below.
I am interested in learning how you on behalf of your Local Authority and other Local Authorities handle requests made by a parent for a copy of the personal data that is included within the Running Sheet/Tracker Sheet.
My understanding is that the Family Procedure Rules 2010 (S.I. 2010/2955 (L. 17) does not apply as the information is not social work data that was supplied in evidence given to the court in the course of proceedings
My understanding is that the information is also not exempt from disclosure by legal professional privilege (paragraph 19 of Schedule 2, Part 4 Data Protection Act 2018).
In respect of the headings shared, any personal data held in a court tracking sheet would be accessible via a Subject Access Request made by a person whose data is held and in respect of the relevant tracker. Third party information would be redacted.
