Fair and lawful sharing of personal information

The Council must be able to demonstrate that the sharing is proportionate and fair to the individuals whose personal data will be shared.

• The sharing of personal information must be carried out for a clearly understood and defined purpose
• The sharing of information should be carried out to meet objectives that can only be achieved by sharing the personal information
• Personal information can only be shared where there is a legal basis for example the data subject has consented to the use of the information

The Council will share the personal information that we hold with partner organisations such as the police or other government bodies, we will do this when it is beneficial to the data subject or to meet statutory responsibilities. We have a duty to protect the public funds we administer and may use or share the information held for the prevention and detection of fraud and other lawful purposes – we do not need consent to share data in these circumstances.

We will not share personal data with third parties that are in a country or territory outside the European Economic Area (EEA) unless either:

• that country or territory has an adequate level of protection is in place for the processing of personal data
• we have made sure other safeguards are in place to protect your data
